The AIBC secured an Undertaking and Covenant Agreement from AECOM Canada Ltd. (“ACL”). The AIBC investigated information that ACL had engaged in the practice of architecture as defined in the Architects Act without holding a certificate of practice and otherwise being registered with the AIBC by preparing and submitting BID documents and drawings for the Sparwood Municipal building renovation project located in Sparwood, BC (the “Project”). ACL promptly retained the services of a BC-registered architect for the Project upon becoming aware that the Project required the services of an architect. ACL agreed by way of undertaking to comply with the Act in future.

The AIBC secured Undertaking and Covenant Agreements from Mark Osburn, Wayne Clarke and Osburn/Clarke Production Inc., B.C. Messrs. Osburn and Clarke were advertising ”architecture” and “architectural ventures” on their web site. These misrepresentations were corrected and they agreed by way of undertaking to comply with the Architects Act in future.

The AIBC secured an Undertaking and Covenant Agreement from Chris Pickard and Pacific Timber Frame in Armstrong, B.C. Mr. Pickard distributed a ‘draft’ company brochure by e-mail advertising “Full architectural design service” and “Architectural Rendering”. Mr. Pickard indicated that he intended to seek feedback from colleagues on the draft brochure, not to offer ‘architectural services’ to the public. Mr. Pickard has agreed by way of undertaking to comply with the Architects Act in future.

The AIBC secured an Undertaking and Covenant Agreement from Boyd Dolha, CTech and Concept Design Build Construction Ltd., in Coquitlam, B.C. Mr. Dolha submitted conceptual drawings as part of a proposal to a local government authority for a project requiring an architect. The authority informed Mr. Dolha that a registered architect would be required for the project. Mr. Dolha was also advertising “Registered Architectural Design” on a seal-like logo on his web site, in his e-mail signature and on certain drawings. Mr. Dolha has agreed by way of undertaking to comply with the Architects Act in future.

The AIBC secured an Undertaking and Covenant Agreement from Khang Q. Nguyen and Architrix Design Studio Inc., in Vancouver, B.C.  Mr. Nguyen removed all references to “architecture” from his company’s web site and has added the disclaimer, “This Company is not affiliated with the AIBC” on his site signs, letterhead and business cards. Mr. Nguyen has agreed by way of undertaking to comply with the Architects Act in future.

The AIBC secured an Undertaking and Covenant Agreement from Ray Kong P.Eng, a realtor, located in Victoria. Mr. Kong was advertising “architectural design” on the ‘realtor detail’ page on the One Percent Realty web site. Mr. Kong corrected this misrepresentation and agreed by way of undertaking to comply with the Architects Act in future.

The AIBC secured an Undertaking and Covenant Agreement from Frida Keihani, a realtor, located in West Vancouver.  Ms Keihani was referring to herself as an “Architect” on her web site and an “Architect of Real Estate” in an advertisement in the real estate section of the North Shore News.  Ms Keihani corrected these misrepresentations and agreed by way of undertaking to comply with the Architects Act in future.
